  • Falsified Defendant Documentation, What Next?

    Hi all,

    Had to take a trader to court following LBA etc.

    Yesterday I received their Witness Statement and Documentation which was emailed to me after I believe they received mine via Special Delivery.

    one document included, an email stating terms and conditions of transaction and another, the quotation having this included have been falsified as on this date I never received a communication to this effect from the individual concerned. All communications were via another individual and terms and conditions were never mentioned throughout.

    my question is how damaging is this for the defendant? Does this kind of thing happen all the time as I would have thought this is against the law?

    now have to wait until the hearing to point this out to the judge but can a judge spot fake from real and what would their stance be in this kind of behaviour?

    shocked by this and makes me feel glad I am no longer dealing with this company for my purchase. Trying to recover deposit paid. They counterclaim for remainder stating loss of profits for something not sold as per terms and conditions they never provided.

    Good luck with your claim. My question is who is the "other individual"? Should they have passed on the information? Did they get the terms and conditions?

      Contact who is dealing with this as the defendant is the manager. They got involved when costs escalated following initial quote, backtracked on doing installation of product as I had asked etc. 1st contact with manager was in September when my request to cancel was escalated. Everything prior was via an assistant. Manager insisted terms and conditions was communicated. My emails show they were not. Falsified email and quote stating terms and conditions is from manager in July yet never spoke to them until September. Use of photoshop and or scanning/photocopy clear on documents. All mine are printed from original and original electronic versions available if court needed these.

      doubt a court would ask for electronic versions to verify legitimatcy.

        That is really helpful information thank you. You would hope it matters at the hearing! I am sure someone with more civil court experience than myself will be along soon to comment but the information you have given will help clarify matters. Once again good luck.

          Thanks for your kind words. Suffering with mental health does not make this easy and probably shows in my post but did not want to be too specific in a forum environment.

          now just to keep the anxiety at bay for the next 2 weeks.
