    Hi there - bit of a strange one but I have recently discovered I have a CCJ against me that is already 2 years old. It was awarded in my absence obviously hence me only just finding out. It was awarded against me at an address I've not lived at for 7 years (5 yrs at the time of awarded). I've not received any paperwork at all ever for it - it was discovered after I randomly used Check My File to see what my credit rating was like. The claimant is Idem Servicing. I have been intending to file a claim to the court to have it reversed/set aside etc so I can challenge for CCA etc as I do not believe the debt is valid or that they could provide a CCA but just haven't got round to it just yet or had the cash spare to file the request to the court. When I contacted the court via telephone to ask about the claimant etc and to find out what I could do I was told there was zero activity on the claim since it was awarded.

    However, fast forward to today and I've received to my current address a discount available collections letter from Hoist Finance for the exact same amount and it says the previous debt is Idem Servicing. It's standard collections letter etc - no mention of CCJ etc and with a 33% discount available if I pay now etc.

    My question is what does this mean for the CCJ - is this normal practice? And what if any should I do? My approach would have been wait to a letter before action in order to challenge (as I would have done if I'd known about it pre CCJ) but I'm stumped about what all this means. Any help gratefully received. Thanks in advance.

Acknowledge Claim - within 14 days from Service

Defend Claim - within 28 days from Service (IF you acknowledged in time)

If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
