  • Legal threat by previous employer

    Hello,

An employer paid money into my account after not working for them for 4.5 years. It took me months to find out who it was and when I questioned them they did not admit to the money for another couple of months, by which time the payments were reduced and then later stopped.

They send what I believe is a pre-actions letter in Sept 2020. The letter had evidence attached but the payments were to two different bank accounts and the total was different to what the employer stated prior to taking action. I completed the letter requesting evidence of the owners of the bank accounts, where they obtain the account details from and also the actual amount as it is not consistent with prior discussions. The form was completed and returned on 29/09/2020. They never responded until today with the letter below.

I am not aware of any judgement that was entered against me as per the letter. I don't live in the UK since Dec 2020 and have not received any of my post due to the lockdown restrictions but still own a house out there.
Responding via post in 14 days is not possible and the letter state that they don't accept email or fax. I am also not even sure what to respond.

Any advice would be greatly appreciated.

    ------ Letter ------

    Dear Sir

    <employer v <me>N

    Claim No. XXXXXXX

You will be aware that judgment has now been entered against you in respect of the above claim, in the sum of
£11,810.98. That sum is now due and will attract interest at the judgment interest rate of 8% until paid.

Unless we have your proposals for payment within 14 days, we are instructed to initiate enforcement action,
which will incur further fees and costs.

We look forward to hearing from you.

    Yours faithfully

They do and that is how they contacted me today. I am not sure why this is the case now as previous email correspondence did not contain that statement.

Also, I checked and I actually have a very recent CCJ on my credit file. I was not aware of it until I just checked so the communications must have been via post and I have not received it yet.
