Quick question hopefully
I had some issues with a builder a while ago and am going through a minor small claim. The judge ordered that both parties serve witness statements to each other and provide Dropbox usernames.
I did this in the time’s frames set but the defendant failed to provide me with his Dropbox user name and didn’t personally send his witness statement. He used to have a solicitor but they ceased to act at the beginning of Jan. however his solicitor despite no longer acting sent something which I can’t open but titles witness statement.
My question is this. Given the defendant is supposed to follow the courts orders and didn’t (a) send the Dropbox username I need to serve him and (b) has not personally sent me his witness statement but got his now ex solicitor (notified by an N434 that they ceased to act) to do this, is he in breach of those orders and should I raise these concerns via an N244 application perhaps
