    Consent to set CCJ aside

    Hi guys, I wonder if any of you could kindly help me.

    I currently have a CCJ against me from 2016 which I didn't know about until recently when I checked my file. After lots of phone calls I finally found out where this came from and I have contacted the claimant and we have come to an agreement for the debt to be settled and he consents to the judgement to be removed as I didn't know it existed but agree to pay.

    I just need to know where to go from here with regards to documentation and the courts ect, what do I have to send the claimant to sign and what do I send on to the courts after this.

      The debt could have been statute barred but by admitting the debt even at this late stage the statute of limitations clock has just restarted. Even when you have paid the debt in full the ‘satisfied’ debt will stay on your credit file for a further six years. When the debt is paid in full you should ask the claimant for a letter of satisfaction to prove the debt has been paid. Send the letter to your favourite credit reference agency so it sits on your credit file as a paid (satisfied) debt. There is no need to involve the courts.

          Statute barred only means the debt cannot be enforced through the courts, the debt still exists and can still be paid. Once a payment has been made the clock starts again.

            I said nothing about the debt not existing. If it becomes statute barred then it remains statute barred. If a payment is made while after a debt is statute barred then it remains barred
