  • Money Claim

My mum was unwell last year. Try remortgage found an independent broker. He tried a few times but no success. Last one I was asked to pay £1900 (admin fees and house survey) but in the end house price drop due to Brexit and lender pulled out.

My financial situation worse. Near end of each month May/ June/July, whenever I near my limit of overdraft, I texted/ spoken to him what to do? Within minutes he just transferred £2000 to my account immediately. I thought at that time his gracious help. Recalled saying to keep afloat and see if any more lender.

Then sadly after 3 months he sent £7000+ and in Aug he said sorry nothing he could do. He gave me some survival tips to seek other options on my own and I was suddenly dropped off. Financial situation worsen.

We exchange texts and updates from time to time until Feb2020 when I received last text from him saying pls start paying, I did reply as soon as I could. COVID-19 struck and no calls or e-mail from both end until suddenly a Money Claim arrived 27/10.

I am very stressed.... writing response due in 2 days!

    - He added 8% interest using County Court Act 1984/ Sec69. for £880 extra along with £410 claim fees - all of which we never talked about or agreed when he lent.
Q.1. Can I say never discussed hence not oblighted to pay? Or what to say? Not fair ...

    - As I need time to prepare and learn more about this.
Q.2. Can I tick - need extra 2 weeks? Any harm?

    - Now, I am sole breadwinner, barely have much left £ with young kids and near overdraft limit each month in difficulties with Step Change.
Q.3. Can I reply the response saying I can only afford to pay £100+ offered monthly starting this month (and ask bank standing order) to payback cover £7000+

    Q.4. Any genuine advice please?
