    Hi all,

    I have gone through all of the relevant motions regarding a car I bought from a dealership of a well known brand who just so happen to have a finance company also under the same brand.

    the letter before action end date was today and I have received no response from them.

    Any help with the below questions would be amazing.


    I bought the car for £26,000 and still have the vehicle although it has been sat in my garage for quite some time now and I have been paying the finance company, road tax and insurance since then.

    I think I need to fill out an N1 form and will need to post it as I have applied for help with court fees. Do I take them to court for the price of the vehicle in its entirety plus the tax, insurance and finance payments paid and also I was thinking £10 a day for no use of the vehicle and £10 for hurt feelings?

    Or do I just put down all of my expenses everything I have paid to finance company etc and sue them for that amount? Either alway I think it needs to be an unspecified amount as I don’t know how long the court process will take so can’t work out exact expense figures.

    can I ask the court to force the finance company to take the car back?

    my main concern, although I feel I have a strong case is that as the vehicle is worth more than 25k if I have to go the first route, the court system starts to get more complicated and I could be liable to full costs of their lawyers fees where I to loose.

Acknowledge Claim - within 14 days from Service

Defend Claim - within 28 days from Service (IF you acknowledged in time)

If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
