  • Perch Capital/ACI/TM Legal county court action

    do you have any experience of dealing with Perch Capital? They’re being particularly harsh on a friend who is going to a final hearing with them in next few weeks.

    Background: payday loan bought by asset collections and investigations then assigned to sister company perch capital and action being pushed by their sister company tm legal. Its a rats nest of bottom feeders giving my friend the runaround and not taking common sense approach.

    So far they’ve failed to provide originals of any documents, only what they claim are copies, there are incorrect details on letters of assignment and also no proof of deed of assignment even though they’ve been asked for over 18 months for sight of such.

    At the preliminary directions hearing done by phone, the judge, clearly hoping for a swift outcome with the minimum of work, simply sided with perch’s advocate and said the “defence would fail” but thankfully couldn’t make a binding judgment, thus kicking the can down the road to the next hearing.

    I’m usually quite confident in these situations but this one has flummoxed me a little. Any tips to bat them off one last time?
