  • Already paid £255 for set aside. Do I need to pay extra £100 if consent is agreed?

I already submitted promptly (11th May) my N244 application (in about a week of becoming aware), paying £255 to have it processed.
The Claimant and I now reached what appears to be a mutual agreement to set it aside by consent, with exception of an additional Court fee of £100 they have been asking me to pay them directly.
My understanding is that an additional £100 would not be required since I already paid £255 for the Court to process my application (bearing in mind I left question 5 of N244 unanswered).
In this case, would I only need to request the Consent Order to be added to my case without any extra Court fees? or have to pay another £100?

I do not intend to pay anything directly to the Claimant prior to a hearing or judgment. On the other hand, I am considering paying the Court directly, or asking them to include the £100 as part of the settlement clause after set aside order is approved (provided this is a genuine ask).

Does anyone know if this is a genuine ask?
Would they have to file another application separately to mine to set aside by consent?
