I am filing an application for an order to obtain information (form N316) in the Small Claims Track at the regional county court. The application was returned to me and I was asked to state whether I want to serve the respective documents personally or have them served by a court bailiff. As there is, as far as I can see, no field for this in the N316 form itself, I attached a letter stating that I would like the documents to be served on the defendant by a court bailiff. The application was returned to me again and I was again asked to state the same thing.
I have done some searching around and have found that the form D89 is used to ask the court to serve documents on a defendant themselves, but, to my knowledge, this form is used in divorce proceedings. What form, if there are any, should a creditor use in a money claim in the Small Claims Track?
