    Hi everyone,*

    For a little background on my situation, see this thread here:*https://legalbeagles.info/forums/for...eposit-england

    I found out today that she's applying for a set aside application. I found this out as the court was calling for a card payment for the court fee, but they called me instead of her for some reason. The judgement by default was sent by the court on the 10th March 2020. Enforcement officers have already obtained a Writ of Control also.*

    Anyways, I'd like to know what her chances of successfully setting aside are?*

    There's a few things I'm a little paranoid about at the moment. I feel I could've written in more detail on the original claim form, and would this go against me in court? In addition, even though I'm a lodger, through text when she asked me how long I thought I would be lodging for, I said "like, 6 months?". Does this count as a legally binding agreement? I did not sign anything and no inventory was taken etc. Deposit was not protected (but she isn't required to as this is a lodger agreement).*

    Really I'm just trying to think of any possible arguments she could argue in court to avoid paying me back.*

Acknowledge Claim - within 14 days from Service

Defend Claim - within 28 days from Service (IF you acknowledged in time)

If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
