    Hello all - complicated matter

    over a month ago my vehicle was towed by a newlyn bailiff for a pcn that was overdue in someone else’s name (friend had been/is still the registered keeper of the vehicle and was driving until present). Was just about to change the v5 back to myself when car was towed. Now dvla won’t issue a new v5 as friend has lost the logbook and I can’t get access to the car to provide a photo of the VIN plate to prove I’m in possession of the car.*

    anyway - the day the car was seized I sent proof of ownership to newlyn in the form of the official receipt of purchase from dealership, a screenshot of my bank statement with the purchase, my insurance policy scan, a photo of the car I had and my id and personal contact details and address. Newlyn rejected this and said it’s not proof and they would be selling the vehicle on the grounds that the log book was in their debtors name. I reminded them that a v5 is NOT proof of ownership and it is illegal to sell the vehicle to cover someone else’s debt.

    citizens advise bureau have reassured me that newlyn aren’t in their rights to keep the vehicle however they are still refusing to return it and keep reminding me that it will be going to auction however it has not done so yet.*
    They also won’t let me collect items in the vehicle which belong to my child such as a pushchair and car seat - things that clearly are needed for care of a child - because I’m not the debtor and they were now controlled goods. I emailed to say I would be collecting anyway as items for a child are not able to be seized in the first place but they’ve ignored this.*

    CAB advised me to send an n244 form to the court which I have done so twice but the court have returned them as I don’t have a claim number - and can’t obtain one as newlyn won’t give it to me and my friend doesn’t have it either. I even called them pretending to be the debtor to ask for it and they just told me to call the car pound - car pound had no idea why newlyn told me to call them as obviously they just store the car and don’t have access to the actual claim.*

    I also emailed the councils parking email to explain what their enforcement company were doing but I got a reply saying they would not speak to me due to data protection and will only deal with the registered keeper

    I’m not sure where to go now as I can’t afford to get legal help and open a case myself. Any ideas? I would not even get any financial return from the vehicle now as it worked out they were selling the vehicle for over quadruple the actual debt but by now the storage charges (£40 a day) will have taken it to that amount anyway.

    You need to submit a Part 85 Claim, its free - Google it - about ownership and let the Court decide.
