    Good morning everyone,
    Please l need your help, l have a loan that l took from Lloydtsb in 2007, l maintain the payment until 2010 when l lost my job. I went to Citizens berau , they advised me that l was living beyond my income, they wrote to my creditors that l can only afford to pay a pound until my circumstances change. I paid the £1 up that until I couldn’t afford as l lost my home, then l stopped paying in 2013 l believe. Lowell wrote me a letter in November 2019, stating that l owed their client some money, they are taking me to court. I requested for the proof of credit to be sent within 12 working days, they delayed sending the info back until 19 th of January 2020.The information they sent showed my agreement but the payment statements *are up until December 2010. Because of what the sent, *l wrote back a the letter stating that my credit was statutory burred. They sent another stating that l stopped paying £5 in 2014 in March , but no statement of account was sent to me proving that, and they started their court proceedings in November 2019, the credit is not statutory burred...., therefore l should pay*
    £100 before 17th of March to avoid court proceedings. My question is do they have a right to take me to court without *proof of my last payments? I am also a full time student, l don’t have any extra money to pay , they are threatening to send bailiffs, taking *money from my employer, but l am not working Please help, what do l do next ! any help will be much appreciated.

    Hi,

    The first thing to do is find out when you made the last payment to see if it is statute-barred and also check all credit files to see if any details have been entered.*

    Also do not ring them or admit to owing anything until you know the status of the debt.*

          Hi,

          It appears that you ave a CCJ as of February 2020. Did you check the other CF's to see what had been entered?

          CCJ's stay on your file for 6 years, unfortunately.*

          Do you have proof that you stopped paying over 6 years ago?*

            Hiya.*
            I can't remember but they sent proof of credit. and bank statements showing last payment December 2010. I have request for all the statements of paying! They have not responded to that, but they keep threatening me .

              Ok, Well if the last payment was in 2010 so that is 9 years ago in December 2019, then the account was Statute Barred (6 years).* Did you admit to owning this debt? *

              Please check if the CCJ was added after the account became SB.* If not contact, payment or acknowledgement for 6 years after your last payment date, then the account is/was SB.

              It's beneficial to you to check you CF's in all areas. *

                I hiya, l did not admit owning the debt, but they keep telling me that my lat payment was 14/03/2014 and the credit is not SB, however they have mot sent the full proof of statements*

                  It appears to be SB, but the only way to find out is by checking all 3 CF. Once you had done this you will be armed with the right tools to stop them from further procedures. It really is in your best interest to check your CF. Have you done this yet?*

                  It's important to see what date your last payment was made and this will show on your CF.* In the current climate checking this will go in your favour as so many things have slowed down.*
