    Hi all

    I received a Court Claim from Lowell a while back and submitted a defence. This is regards to an alleged Capital One debt. I sent the 'prove it letter' at the point I received their first response.

    I have now received a letter from a Paralegal from Lowell with their 'evidence' which consists of

    Exhibit LG1 - A printout of Capital Ones credit agreement with my name on in print, their header reads it is an 'electronically signed' one, I can't see any signature or even where this is allegedly electronically signed.

    Exhibit LG2 - A 'statement of account' which appears to show transactions which looks like it has been knocked up on Microsoft Word or a similar program, no logos or anything on it, to be honest I could make one of those.

    Exhibit LG3 - A copy of a Default Notice.

    Exhibit LG4 - A Copy of a letter saying the account has been transferred, again no header or logo, just as if it has been done on Microsoft Word or similar.

    I am after some advice as to whether this would stand up in Court.

    They didn't reply to any of my previous contact and I have refused Mediation, and all of a sudden they have this 'evidence' which looks all official but In my opinion proves nothing.

Acknowledge Claim - within 14 days from Service

Defend Claim - within 28 days from Service (IF you acknowledged in time)

If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
