Hi guys, my dad went to the court on 3rd. His english is average on a good day. Basically he took a car from black horse which is the company that allow finance for people with less than good credit rating, he missed few monthly payments and blackhorse decided that they want the car back. He went to the court on 3rd of October to convince the judge that he will pay back all the arrears, but he wants to keep the car. Today we received a letter from court. Could someone translate it to me? Do we get to keep the car? I am not sure what does it say. Thank you.

Hi,
I'm not so sure you are giving us the full story here. Blackhorse can't simply say they want the car returned because they have contractually agreed for your father to use it in return for payments. Judging by the order, I am going to presume that Blackhorse are alleging non-payment and they therefore terminated the agreement seeking recovery of the car.
Your father has to file a defence and specifically address what appears to be his argument that he has been paying £200 per week. If you want any real help from us, then you are going to have to provide us some more details, ideally:
1. Background leading up to the court claim and hearing.
2. The Claim Form and any other Particulars of Claim.

Yes, that precisely what happened. Blackhorse terminated the agreement because of problems with payements. He was supposed to tell the court, that he WILL be paying the 200 a week to get rid of the arrears, but it looks like he messed it up and told them he was paying and he believes blackhorse are wrong telling him there are any arrears. What do you think is the best course of action? Thank you.
