  • Claims Guys - is this legitimate?

    Claims Guys did a PPI reclaim for my son from Barclays around 4 years ago. He received the payment as per their T & C's. No complaint with that though of course now he knew about their costs he didn't wish to involve them further with anything else.
    Out of the blue, Barclays contacted my son around 3 months ago advising him that they had overlooked a previous credit card. I believe it was a one that had been transferred over by when Egg lost its way. Anyway, it wasn't an original Barclays Visa.
    So I put together a claim for him and specifically told Barclays that Claims Guys must not be involved.
    Correspondence from Barclays showed that they had been CC'd on it.

    Today he was called by Claims Guys and advised him that the case had been won and wished to take it forward. They wouldn't even tell him the amount of the award.
    He cut them off at that point and referred it over to me to sort out.

    Where do I go from here?
    Do I (or my son) contact Barclays again directly and press for payment direct?
    If they agree to that what would be situation regarding Claims Guys who may feel they have a right to fees, perhaps by some sort of all inclusive contract he initially signed, even though they have never done any work on this claim, nor even knew about the actual outstanding card potential.
    We just don't want to get swallowed up in legal claims from them if they feel they have rights, but naturally my son feels that since we did all the work and all the correspondence they have contributed nothing to the repayment or even getting Barclays to consider the account in question.

    It seems you withdrew any third party authority that Claims Guys held and Barclays were wrong to include Claims Guys in any correspondence.
    You're probably going to have to ask Claims Guys for a copy of the contract he signed, and also ask Barclays for a copy of the signed third party authority which gave them permission to share your sons personal financial information with a third party. Once you have those you'll have a better idea of where he stands.

      Well they sent bucketloads of stuff that was more or less impossible to correlate into a useful argument to their claim. However I pushed them on it and asked specifically which document they sent actually gave them ongoing authority. From that they sent the whole shebang to the FOS for their ruling. They didn't really come out on anyone's side but told the Claims Guys that because of the longevity of the process to sort things out they were allowing the claim to be dismissed. Of course Claims Guys came back and said they had cancelled out of kindness........

      So. Always worth pushing these sort of people.
