Lowell Solicitors CCJ for o2 contract

  • Lowell Solicitors CCJ for o2 contract

    Good afternoon all,

    I have found out at the beginning of March 2019 that back in 2017 Lowell solicitors have recorded a CCJ against my name. The CCJ is for an O2 contract which I cannot remember to take ( apparently the contract was taken on 2nd December 2014) . I've had an O2 contract which finished in 2009. Since then I have moved to another provider.
    I've contacted Lowell for some information on the debt. I have asked for any statements, account details, dates of when the contract has been take out etc. However Lowell has only provided me with very basic information such as the address registered against the contract, The contract start date and when the contract has been cancelled. That's about it.
    I've contacted Lowell again to gain some more information but since then I've not received anything.

    I know that the CCJ claim has been sent to the my old address, and I was unaware of this debt. The claim was issued on 11th May 2017. I've moved on June 2016. Wen living at the old address I've never received a letter from O2 or Lowell solicitors to inform me of this debt.

    I know that I can set aside this CCJ however I'm unsure if I have reasonable grounds to do so.

    Additionally, how can I approach Lowell to gain more information on the debt? as I cannot find any paperwork at home which would confirm that I have taken this contract out with o2. My Bank statements do not show that I've made any monthly payments to O2 since December 2014.

    I would appreciate your guys help as I want to resolve the issue as this CCJ is on my credit score and getting a mortgage in the future will be impossible.

    I know that the CCJ claim has been sent to the my old address, and I was unaware of this debt. The claim was issued on 11th May 2017. I've moved on June 2016. When living at the old address I've never received a letter from O2 or Lowell solicitors to inform me of this debt.
    That should be enough grounds to set aside.

    I'd send a SAR to O2 as well while you're sorting out your application to set aside.
