    Wrong Date

    Back in January I was questioned about an offence related to 2 specific dates. This week I received notice to attend court however one of the dates on the summons is different to the dates I was questioned about, Will this get the matter thrown out of court? If so can the police resubmit the claim again with corrected dates? If it isn't thrown out and accepted as an administration error should I prepare my defense and fetch witnesses to defend the allegation related to the corrected date?

    Will this get the matter thrown out of court?
    No.If it is raised as an issue the prosecution will simply ask the court to amend the allegation, to which they will almost certainly readily agree. The issue is whether you were disadvantaged by the error and the answer to that is almost certainly "No". You knew when the incident took place.

    Acknowledge Claim - within 14 days from Service

    Defend Claim - within 28 days from Service (IF you acknowledged in time)

    If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
