I had a favourable judgment from an Employment Tribunal back in January for unpaid holiday pay. The judgment also specified an award under section 38 of the Employment Act 2002.
The Respondent hadn't paid after 42 days.
I paid my £66 for the fast track High Court route to enforce the judgment. When confronted with this by the HCEO, the Respondent paid up. However, he has since convinced the Employment judge that he shouldn't have to pay the section 38 award, so the original judgment has been "varied". My payment is still being held by the HCEO.
Simple question - does the original writ still stand? or would the Respondent have to apply to the HC to have the writ set aside?
