Hi yesterday I received a letter from arrow global saying the account has been transferred to drysden fairfax solicitors with a date of original agreement lloyds black horse on 04/11/2003 . I don't know anything about this debt at all, althouth the address on the ccj matches where i was living at the time in 2003. I've moved about loads since 2003 and never heard anything about this before. So talking to a couple of mates one has said to try noddle to see if anything was on there, so I've done that and there's an active CCJ with the same amount showing with a judgement date of 18/9/14 with the county court business center ? Can someone explain what I need to do as I'm all confused on where/What to do, any advice on where to start would be a great help thanks

approx how much (round figures) the outstanding debt was?
What type? (Credit card, loan etc.)

What are you aiming to achieve?
Do you want to vary the payment order (ie pay via installments), or do you want to try for a set-aside of the CCJ & recommence fighting the claim? (Could cost you £255 to make an application....£100 if you can get the Judgment Creditor's consent.)CAVEAT LECTOR

The CCJ stays on the register and credit file for six years, so should fall off next September (2020) so IF it is your debt ( ie if you had a loan with Blackhorse in 2003 which defaulted after August 2008 ( over 6 years before claim was issued )) then if you get it set aside and find you are unable to defend it or settle it you could risk the ccj being reapplied for a further 6 years ( so to 2025)
However you could set aside and then settle it ( if it were your debt? Or you could set aside and defend it ( if it's not your debt). If it is yours you could settle it now for a certificate of satisfaction if your credit file is important - or just set up installments going forward to avoid it going to any enforcement.
I think therefore first thing is to try find out about the original debt - possibly checking your bank records from 2003/4 to see if you'd made any payments to Blackhorse or asking Blackhorse directly - either phone them and ask if they hold any records or sending a subject access request to them.#staysafestayhome

Ok rang the county court business centre and have been told it was a joint account CCJ with one of my ex partners . Also rang drysden fairfax who have said I am liable for the full amount if they can't trace the ex partner...should I just bite the bullet and offer to pay instalments? Thanks

It depends how you feel about the CCJ being on the register and your credit file for the next year or so.
Also - do you now recognise the debt ? Joint bank account overdraft or loan ? It's not something your ex had taken out using your details or anything ? ( it happens) Do you have contact at all with the ex - any idea if they are still at the address ? Any idea when it would have defaulted / last been paid ?#staysafestayhome

Tbh a wait of that long for it to fall off isn't too long away, unless there is another way?. Yes I do recognise it after a few phonecalls this morning it was a joint loan we had taken out. She did do me alot of damage(taking out loans/payday loans) as i worked and she intercepted the mail while she was a stay at home mother. I do keep in contact with her as we do have children together, No she has moved about a lot more than me so they probably can't find her. I feel sick to the stomach that I'm left with yet another debt to pay that I knew nothing about..mind you it's the only debt left that she's left me with.
