  • Help with completing 'Directions Questionnaire':

    I wondered if Forum Members could help me please. I am the claimant in a case to be heard in the small claims court & I'm now required to complete a 'Directions Questionnaire (small claims track)'. I'm seeking help on how to respond to the following question so that I can justify the reason/s why the case can be heard at my local and preferred county court: Hearing venue - At which County Court hearing centre would you prefer the small claims hearing to take place and why?

      Thank you OSTEL. I am sorry I should have clarified at the beginning - the Defendant and I are both individuals with no business representation or links whatsoever.

          So, you are the claimant?

          Is the defendant near you, geographically?

          Just ask for your local county court (specify which) and say you are an individual representing yourself. If you have any special needs or disabilities, cite those.

          If you and the defendant are near each other there should be no conflict. If the defendant asks for his local court, and it's far away, the courts will normally allocate the case to a court near the defendant.

            Thank you 2222, yes, I am the Claimant. My local court is in Norwich and the Defendant's is Colchester. From what you say, and what I have been suspecting, I may not have any realistic chance of having the case heard at my local court. The reason for the preference is purely logistical. I will propose my preference and see what I get back. Many thanks once again 2222.

              Acknowledge Claim - within 14 days from Service

              Defend Claim - within 28 days from Service (IF you acknowledged in time)

              If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
