  • Non-Existant CCJ

A couple of years ago I hit a pretty tough spot in life and I got myself into a lot of debt in a short space of time. One of these was a loan with Lending Stream. Once I came to my senses I begun paying off my debts by getting rid of the smaller ones up to £500 before tackling the larger ones with a DMP. The loan with lending stream was later sold to assist collections and investigations. Again a little while later TM Legal got involved saying they were acting on behalf of Assest collections and imvestigations. But during the month of January I began getting emails from TM Legal saying they had intentions of taking me to court over the lending stream loan and I had X amount of days to reply or pay the loan. I never received any letter from TM Legal or any Court regarding this intention. I already have one CCJ that I'm currently paying off so I know how the process goes. So I ignored this until I actually received notoficnotif from a court. In mid January I got another email saying they have requested a county court to make a judgment. Again, I still have no letters from a court. TM Legal have also not provided any details on which county court they have gone too, no claim numbers or any relevant information regarding a court. Then I got this on January 23rd via email.

"We, TM Legal Services Limited, are instructed by Asset Collections and Investigations.

You now have a County Court Judgment registered against your credit file. You can verify this on a public register, The Register ofJudgments, Orders and Fines.

If you pay your County Court Judgment in full within 30 days of it being issued, the courts will be notified, and they will remove the County Court Judgment from your credit file.

As you have a County Court Judgment, it will stay on the Register of Judgments, Orders and Fines for 6 years, which will be affecting your ability to obtain credit. This record can make obtaining credit in the future more expensive and can seriously affect your ability to obtain a mortgage, credit card, bank account and even a mobile phone contract in the future."

As of today, 04/02/19, I've still had no letters from the court and no other information from TM Legal. This has made me suspicious so I decided to look on the register of judgements orders and fines to see if this CCJ existed. After performing the search the only information about myself was the CCJ I'm already paying off. The CCJ TM Legal has said I've been given does not exist.

    How do I proceed?

Give court a call with the claim number (or your name and address) and check the status ( or existence) of the claim with them. Today.

    Northampton CCBC - 0300 123 1056
( it's the moneyclaim bulk claim centre which is where Asset/TM issue claims through)

If there is a default CCJ you want to ask them to send you the details and that you intend to apply to set aside. Ask the court what address it was issued to and tell them you haven't received anything from the court but you have had a letter from the claimant, both before and after the claim was allegedly issued. ( IT might be the courts cock up as much as Asset's )

It may not appear on the register or your credit file for a month after the judgment is awarded so it really is best to check that Asset/TM didn't issue it to a wrong address/old address etc.

If there is nothing with the court at all then look into it further with Asset.

This isn't relevant to your questions but is something extra that could help with your general situation.

Have you looked at making payday loan affordability complaints, to lending Stream and to any other payday lenders you used? See https://debtcamel.co.uk/payday-loan-refunds/ for more about these and how to make one.
