    Hi

    I am making a claim against a company and it has now been given a trial date. The defendant didn't send me a copy of his defence or questionnaire and it has taken me weeks to get a copy from the court. I finally received a copy this morning and the defendant, like me, has agreed to mediation. Should I have been given a trial date before mediation as I now only have a few days until I have to pay the trial fee and should mediation services have contacted me considering the questionnaires went back in November?

    I called the court today and was told they didn't know why this had happened and could only assume the judge decided that it wasn't suitable for mediation. I can see no possible reason why it isn't, I thought the court actively encouraged resolution before trial?!!
