Hello we had some work done and it was badly done
After months of offering ADR and surveys etc to follow the protocols and being ignored the company are taking us to court for their money
The perhaps simple question is this, if a manufacturer supplies fitting instructions, and the builder does not fit the parts to the instructions, would it be classed as wrongly fitted, or would some type of argument such as it will still do the job pass as acceptable, for instance a waterproofing membrane should be rubbed down to give a good seal to stop high winds driving water under tiles, and the builder just lays it down loosely and (roof ) tiles over it. upon inspection rain could easily be driven under. I have talked to the manufacturers and they say it is wrongly fitted,
In court what would be the opinion in a legal way
I guess its the fear of a stupid ruling that has me worried
