    Firstly i apologise for the long post, I'm new to this...

    I received a letter on the 17 November dated 6 November from TM Legal Services and am unsure of how to proceed. Not sure if it is a claim or a letter before action. It is bold and underlined "LETTER OF CLAIM".

    It for a payday loan from The Lending Stream and the balance is £200.80. The letter states..

    "Following the assignment of your loan(s) to Asset Collections & Investigations Limited, they have made several attempts to contact you in relation to the arrears on your account(s), however, they have been unable to engage with you. Our client attempted to contact you to try to establish an understanding of your personal and financial circumstances, so they could look to agree a suitable resolution, such as an affordable and sustainable payment plan or reasonable offer of settlement.

    Consequently, as you have failed t respond to our client or failed to maintain regular payments, the sum of £200.80 remains unpaid and they have instructed us to consider the issuing of County Court proceedings to recover the outstanding balance.

    In order to prevent this from happening you will need to contact us to discuss a suitable method of repayment. This may involve us agreeing to you paying the outstanding arrears under a payment plan if this is affordable to you"

    It then states if they are not in receipt of full payment or have an agreed plan in place or a completed reply form within 30 days of the date of the letter then they may commence legal proceedings without further notice.

    My points are:

    1. Before this letter I have never heard of or been contacted by Asset Collections & Investigations Limited..
    2. Is this a CCJ Claim form?
    3. If so, why have I not received a letter before action?

    I agree I owe Lending Stream money, If I offer to pay £50.00 a month are they likely to accept this without going to court?

    Then there is a reply form asking me to tick some boxes from A - I, and a financial statement form.

    Can anyone help? Thank you.

    It's not a claim form, it's a letter before action telling you they will be bringing a court claim if you don't get it settled/agreed before the 30 days.

    I'd expect a £50 a month offer would be accepted and would avoid the need for litigation. If you have no disputes over the amount of the debt and it's relatively recent then that is likely your best option IF £50 a month is an affordable amount for you. Alternatively you can just contact TM or Asset and negotiate with them directly - if you do that just ensure any agreement reached is put in writing.

    You can complete the IE form and make your offer through the Income Expenditure sheet - you can also use the form to ask for copies of documents if you do have any queries over the debt.
