  • Court still not removed CCJ

    Hi all

    i recieved a letter from Lowell issuing a notice of discontinuance on the 27/9/18.

    They sent a copy to me and the courts. The court failed to remove the CCJ from my file so I emailed them. They said they can’t unless they had a copy of the letter (which they already had) I’ve emailed them 3 more times attaching copies of the letter and sent a hard copy yet they’ve STILL not removed the CCJ.

    the court in question has been completely useless from the beginning of this whole saga and I’m getting more and more annoyed.

    is there anything I can do to remove it from my report? I use Noddle and ClearScore yet they say they can only remove it if the court informs them to.

    Have Lowells not informed them? I doubt whether they will take your word as in this day & age it is so easy to replicate a letter.

      Have you provided the order from the court that set aside the original judgment AND the notice of discontinuance ? The judgment should have been automatically removed around 28 days after you had the judgment set aside originally.


      This order.
      Upon reading a letter from the claimant and the defendant.

      IT IS ORDERED THAT:

      1. The order dated 23 March 2018 is set aside.

      2. The claimant shall disclose to the defendant the credit agreement on which it relies by 4pm on 24th August 2018.

      3. The defendant shall file and serve a defence by 4 pm on 14 September 2018.

      4. The claimant shall file and serve a reply, if so advised, by 4pm on 28 September 2018.

      5. Both parties shall file and serve directions questionnaires by 4pm on 12 October 2018.

      6. No order as to Costs.

        Lowell did inform them. It stated on the letter from Lowell that a copy had been sent to the court.

        Amerhyst I sent them everything. I’ve not heard anything from them since

        Acknowledge Claim - within 14 days from Service

        Defend Claim - within 28 days from Service (IF you acknowledged in time)

        If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
