    hi guys,
    So, following on the case form here:http://legalbeagles.info/forums/foru...ms-help-please

    I have applied for a set aside order, but the guy who won counterclaim is filing for enforcement today...
    So, i wondered.
    Does enforcement send me a letter, or just land at my door with a big hammer

    1. If i get a set aside order granted before the enforcement deadline, will i be ok?
    2. I travel away on sat for 7 days, there is good chance enforcement letter will arrive when i am away, so how can i manage this when i abroad.

    What enforcement is he filing for ? Warrant of Control ( so bailiffs basically?)

    You have filed your set aside application already - so there should be a bar on the file stopping any enforcement being applied for - might be worth checking with the court that all is received and lodged properly so the enforcement application will just be held until that's sorted.

      your great help.

      Its enforcement of a court order to pay his counterclaim.
      he filed the enforcement yesterday but my set aside order just got admitted today, so he got there first.
      If the judges sees the set aside today and grants new date, i should be fine.?

      Acknowledge Claim - within 14 days from Service

      Defend Claim - within 28 days from Service (IF you acknowledged in time)
