    Good Morning All

    Apologies for the lack of updates, I have been on leave on a family holiday and prior lost my job and got a new one so mind being elsewhere.

    I last received any response on the 23rd of October 2018, saying the claimant basically needs to contact the court within 28 days of receiving my defence or will be stayed.

    Logged on MCOL, nothing has changed;

    Your acknowledgment of service was received on 27/09/2018 at 12:02:03

    Your defence was submitted on 23/10/2018 at 10:30:13

    Your defence was received on 23/10/2018 at 12:02:05

    Am I just to wait?

      ring the court and ask for latest update probably stayed

        point 1:- when court case issued keep in touch even with holidays etc, because you miss a court direction etc then a back door CCJ could be obtained by your failure to respond to directions. = cost you the case and no doubt a hell of a lot more monies. keep alert

          Just called them to ask, and it was stayed 2 days ago as they had no response.

          Still, they can proceed on application again

            Okay good, your mortgage should be okay at least.

            In January review things if you've had your SAR back from Lloyds and any documents from PRA. Then you might have a couple options either to settle at a reduced amount on the grounds the claim is withdraw, or apply to strike based on abuse of process.

            Do you know if you had any PPI on that credit card ? ( it'll show up in the SAR if you don't know ) Just thinking the reason you stopped payments was due to injury - that stopped you working? and the PPI should have kicked in to cover you ( if you had it )

              I sorted my mortgage out a month or so back, takes effect on the 1st of Jan. Did a 10 year fixed at 2.65% so cant complain

              I will of course keep you all posted
