    My wife has been bombarded with emails over the past 2 weeks from these cowboys regarding an old ccj, we are doing our best to address all the historic debt from her previous relationships.

    We have gone back to them with any offer of payment along with their income and expenditure form.

    They have ignored the offer and are constantly threating either an attachment to earnings or a warrant of control every other day now.

    We have gone back to them on numerous occasions stating we have responded and are awaiting their agreement on the offer

    The CCJ is on my wife's credit file, I have checked already, we want to pay something each month, but it seems these emails are automated.

    My question is can they actually enforce their threats when we have proof we have responded and made a offer of payment.

    Any help or advice would be most appreciated

    YEs TM legal seem to send out these threatening emails constantly - they don't actually seem to do what they threaten though. Is the CCJ actually with Asset and TM Legal are acting for Asset ? Old payday/short term loan type debt?

    Might be worth trying to speak directly to Asset. Otherwise you could file at court with a N245 application to make your offer of payment based on your IE and have it formally set by the court... there is an application fee ( £50 ) involved in doing that, but if it gets set that way it should cease the harrassment from TM Legal ( we should write and tell them to stop hassling you anyway when you do the application )

    Do you know what the actual original judgment is for ? Are you happy just accepting the CCJ and sorting out payment or do you want to challenge the CCJ ?
    Did you know about the court claim that pre-ceeded the judgment ?


    These kind of emails ???

    Following our recent letter, you have failed to contact the office to set up a repayment on your County Court Judgment. We are now in the process of contacting your employer to verify your status of employment.

    Once we have confirmed the status of your employment, we will complete an N337 Form (Request for Attachment of Earnings Order) and present this to the court. We anticipate this form will be completed in the next few days.

    After this form has been completed and sent to the courts, we are unable to retract the application and your employer may be informed of your County Court Judgment. Once the Attachment of Earnings has been applied for, the courts will issue you an N56 Form (Form for Replying to an Attachment of Earnings Application Statement of Means).

    You must fill in this form, giving details of your financial circumstances. These include your employer's details. You are required to include your partner’s financial circumstances also. You must return this to the court within eight days.



    Email 6th October
    We will shortly request that this is transferred to your local court for enforcement action against you. We intend to enforce this Judgment against you by way of an Attachment of Earnings Order which means your employer could be ordered to deduct money from your earnings to pay off the outstanding County Court Judgment.

    This application will add £110.00 of Court Fees to the Judgment amount outstanding. In attempt to try a....

      Yep spot on, the ccj is for a payday loan, we accept the debt we owe it and have got payment plans with other creditors, will find out who they are acting on behalf of and go to them directly

        It should be listed on your credit file or the judgment register with the judgment holder's name - likely to be Asset International Collections - TM Legal don't own the debt themselves, they just chase payment of court judgments. If not, you should have a claim number ? the letters from TM should have that on anyway, and you can call the court to get the claimant's name ( ask them to email you a copy of the claim details ). ( Northampton County Court Business Centre most likely )
