  • Solicitor refusing to send paperwork to complete my court order I was awarded

    Hi

So I instructed a solicitor to represent me at court back in Feb for a child arrangements order. This case was agreed and I agreed to pay £100 a month to cover the cost which I have been doing. The court concluded in June and I was awarded a final order. My solicitor is now saying he won’t conclude with the court until I clear the balance in 8 months time. I need this court paperwork to stop my ex taking my kids! Will the court let me have a copy if i write to them?

Call the Court and ask if they can send you a copy of the order, then you should be able to find out what, if anything the solicitor actually needs to do to conclude the case. If you do have a final order (just don't have a copy of it) and the case is concluded I'm not sure what else needs to be done by your solicitor.

They are able to withold documents as security for payments but I very much doubt if this extends to a court order, made in your favour. Was your ex present at court? If so they should be aware of the order, whether you have a copy of the final order or not, it is in force.
