I should one again reiterate the difference in standards of proof between civil and criminal courts.
In a civil court, the requirement is the balance of probabilities (i.e. more likely than not).
In a criminal court, the requirement is that juries are persuaded "so they are sure".
If you cannot prove you were discriminated against in a civil court (where the standard of proof is a lot lower), you stand next to zero chance of proving the same claim in a criminal court.
