    Okay, just by way of an idea... the business bit is simply so they understand there is an actual need to provide more information if they are to claim on the debt.


    Dear Restons,

    Reference: copy their references from their letter

    Thank you for your letter dated 5th September 2018 in which you indicate that 'Arrow Global ( Guernsey) Limited' have referred an alleged debt to you for legal action.

    The debt appears to be quite old, I will need to check my records as currently I am not sure to what it refers and believe it may have been a business debt for a company which was liquidated in 20xx. Additionally I do not recognise the alleged original lender stated ( MBNA - AOL Bertlesmann Ltd). To that end I have requested a copy of the original credit agreement from your client, Arrow Global, as is my right pursuant to section 78 of the Consumer Credit Act 1974 ( please find a copy of such request enclosed for your information). I have also sent a Subject Access Request to MBNA's data protection department for further details of the alleged debt.

    I would also be grateful if, as the managing agent for the account, you could provide me with a full statement of account, notice of assignment and any default or termination notices relevant to the debt. I am, of course, concerned that any debt from 2001 may well be time barred pursuant to section 5 of the Limitation Act 1980.

    I would be grateful if you could hold any further action on this account until such time as I have received responses from your client and from MBNA, and had opportunity to review the documentation. I have no intention of avoiding payment of any legitimately owed debt, but this is rather historic and as such do require more information before I would be in a position to consider settlement.

      Every cloud.... So yes a CCJ would be a pain in the bum now after you've just managed to get things back on track, so if documents show up and all is in order you should be preparing to negotiate, probably, a smaller reduction in the debt, payable by installments. This was 2001, and would be a hand signed credit agreement, MBNA agreements from around them can be a bit tricky for creditors - whether all the terms are present etc. Once you do get any documents if there are more technical arguments to defend a case you could probably get a CCA lawyer to assist with the defence on a CFA ( conditional fee arrangement ) when they obtain their costs from the other side. It would be good to get it reviewed by a professional in any case if they do provide documents simply as the case, if they went ahead, would be in the fast track so full costs may be applied. But early days yet... they may just make noises and not bother with court once they know there are legitimate queries and that you're likely to defend the case.

      ( F&F settlements wouldn't be accepted if you'd be paying by credit card so that is out the window )

      My clearscore is down at just over 200 so you're doing much better than I am ....

        Oh, I'm presuming you didn't go into any formal debt solution when you lost the house, like an IVA or bankruptcy or anything which would have included this debt ? Was the £1 through a formal DMP arrangement or just your own negotiation with MBNA ?

            No i went into agreement with MBNA no formal debt management the house was repossed as i could no longer afford payments, also in asnswer to earlier question regards Financial Statement, I am self employed and do not earn lots anyway, would my wifes income be taken into account - she has only been my wife since Feb this year ......

              I missed this sorry, I will ammend my letter to Restons, it was not a business card and i was a sole trader (again if only i had new then what i now know !)

                The debt is in just your name so no, it should only account for your income and expenditure.
                Good news on the MBNA payments, if they continued past when it was assigned to Arrow in 2012, Arrow might not know about them and you might have a statute barred issue to play with. Think you mentioned you think you stopped those 3 years ago - so 2015... so the SAR to MBNA should show up whether they were passed on.

                I'll have a look over the letters

                I'd do signed for on the CCA, the others just get a posting receipt.

                  CCA request - change the We to I, and Our to My throughout.

                              The letter have all been posted and i added the business thing back into the letter to Restons, I am away for a week from tonight so i wont know what arrived in the post until i return a week on Thursdasy - again many many thanks xx

                                IMHO they are a cowboy outfit looking for low hanging fruit. After 18 months I got a letter saying they will not take forward to court. I simply followed the request for info 31.14 & posted a defense. Restons send lots of LONG official looking letters but couldn't provide any evidence.

                                My advice is hang in there & follow protocol & be prepared to argue your case. Do not react to any of the letters because it's all bluster.

                                For some bizarre reason Restons launched a second random £500 claim during the mediation period, which I forwarded on to the courts & did not reflect well on them. Really Restons should be done for fraud!
                                Hi Chris,

                                I don't wish to confuse the matter so Follow the guys advice here & protocol - follow courts timetable not Restons. Remember it's not cost efficient for Restons to go to court & the burden of proof is all on Restons.
                                But 14 grand is a hefty amount so your particulars will be different to mine - keep going, stick to your guns & try not to worry.
