I hope someone could shed some light for me and i would be grateful for any advise.
I filed a claim in the small claims court for damage to a vehicle that was caused by an automatic barrier.
The defendant has filed a defence and counterclaim which from what i have read, I am now the defendant part 20.
The counterclaim amount from the other party is untrue, they are counterclaiming for me to pay for the costs to the barrier, they have sent an invoice for the work. I have pointed out that within the invoice they are trying to bill me for additional items placed onto the barrier system after the incident, this has been confirmed by the barrier installation company during a telephone conversation.
As I have pointed this out they have made a false claim form N9B that they know is untrue and is signed.
I have evidence to back this up also.
Could anyone advise me on what I do from now. Do I defend all the points in the counterclaim and then counterclaim them back for the damage to my vehicle? also can I take the false statement they have made to have the counterclaim set aside some how.
