  • Asset Collections /Lending Stream - Judgement by Default

    Hi all

    i have received a judgement by default from Asset Collections and i would like some advice please.

    I have received random emails from these people but tended to ignore them as i never received anything in the mail.

    i have not received a Letter of Claim nor have i received any court papers.

    i moved house in Fenruary 2018 and updated my electoral records with all 4 credit reference agencies showing this, si i can't be that hard to find.

    i received an email on 10th July to advise they had started a Court Claim but could never get through to the court to clarify if it was real.

    so i wrote to Asset denying any liability and asking for various information. I also advised them of the correct address.

    it appears they have ignored my letter nor supplied the correct address to the court. I spoke to the court today and Asset requested judgement on 1st August. My letter was recorded delivery and they received it on 25th July.

    i have today written to Asset with these facts and asked them to consent to the judgement being set aside. If they do not reply within 7 days i will submit the form to the court myself. Can i ask the court to make Asset pay my fee if i am successful?

    The guy i spoke with is going to email me the Particulars and in the mean time i have done a SAR to Lending Stream.

    is there anything else i should be doing as well?

    Sounds like you are on top of things and Asset were misleading you previously ( you should make a complaint on that as well - were TM legal involved at all?).

    Yes you shouldn't have a problem getting your set aside application costs awarded to you particularly considering you'd written to them before they requested a default judgment .... were they writing to you about the alleged judgment or emailing ?

      Thank you for replying and please excuse my spelling in my first post. I was rushing to get it typed in my lunch hour and on my tablet. Not the best combination.

      TM legal are not involved yet but I have encountered these muppets before so it is probably just a matter of time.

      Asset have only ever emailed me. Nothing ever received in writing.

        Okay.

        A CCA request to Asset will also be useful although they may refuse to comply until after you have set the judgment aside.

        When end you get the particulars of claim get them posted up and will give you a hand with your set aside application ready for when they refuse to consent.

        Acknowledge Claim - within 14 days from Service

        Defend Claim - within 28 days from Service (IF you acknowledged in time)

        If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
