  • Direct sales company seeking action against poaching direct and indirect

    I was self employed with a UK based Direct sales company for 2.5 years and built a business of £2m and a team of 600. Due to the lack of stock, support,bullying which wasnt dealt with and high restrictions I left the business on Friday 25th June 2018 This was to protect my mental health and reputation as the consultants blamed us for a lot of the issues caused by head office . I started with another company and proceeded to build my business. I have a large following on my faccebook so kept them informed about my change without dissing my old company. The old company are now seeking legal action stating that by posting certain things on social media I am indirectly enticing consultants to join me. I have over 6000 followers on facebook - my old company had 7700 consultants in the whole of the uk so I only have a small percentage on my social media. At no time have I made contact first with any consultant, named or compared. and with the problems with the other company people where leaving before I did . Could some one please advise on where I stand.

    This is a specialist area, so you would be best advised to speak with a commercial lawyer. The situation will depend upon what agreements you signed with the initial company, notwithstanding that if they failed to perform their obligations or behave reasonably, you would have grounds for terminating it in any event. The old company obviously doesn't like the fact that you have been successful elsewhere, so my initial thoughts are that's tough sh*t as far as they are concerned. But really nobody can help you without a detailed overview of the situation. For you to post snippets on here and get "advice" from people who are not fully legally qualified in most cases could be a dangerous thing to do. This is a job for a pro if ever there was one!
