  • 2ND CCJ - Please help!

    Hi all,
    Hope someone can help me with this...

    Back in 2016 I had a CCJ taken out against me. I appealed this, went to court and ultimately had the debt set aside. Due to timings of this matter and by order of the court I made a protest payment of £50 which was agreed with the claimant Lowell Solicitors, I agreed this over the phone and then sent follow up emails. Surely after the court had set this aside and making evidently clear the payment was made under protest the county court would understand this given that they had set the debt aside?

    I then requested proof of the debt under the CCA, more than 12 days had past...over TWO YEARS have passed and I still haven't had this sent to me.

    Lowell Solicitors have now taken a 2nd CCJ out against me under the same debt even though they haven't provided sufficient evidence, the debt is technically statue barred and they failed to deliver any information.

    I have moved house, I have received no default notice or counter form from the court. I therefore haven't had chance to appeal this and now I have to appeal.

    Goes without saying I am going to appeal this as I have EVERYTHING in writing still from the last CCJ.

    Can anyone offer any advice?

Acknowledge Claim - within 14 days from Service

Defend Claim - within 28 days from Service (IF you acknowledged in time)

If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
