  • Lowell Solicitors taking me to Court need advice urgently

    Today I have received two of the following correspondents One from County Court for a hearing which could last up to 2 hours and another one from Lowell Solicitors who after 60 days sent me what I think is CCA. Debt is over 9 years old and from my understanding, it should have been written off further they sent me a bank statement that looks nothing like a bank statement stating I paid £5 pounds in 2013 which, to be honest, I can't remember

    during this timeline, I have been unemployed for over 6 years and was a student I received hundreds of phone calls and final day notices letters.

    What are my option and what can I do? I only recently found a job and need to clear my mortgage debt first.

    your advice would be very much appreciated what do I need to say at the hearing

    Attach form the first post is what I think is CCA from Lowell my personal details have been removed

      Ok so I'm afraid lots more details are needed.

      You say you think it should have been written off- why is that?

      I see it was opened in 2009 but when was it defaulted?

      More questions I am afraid

      I guess you have received a claim, acknowledged it and submitted a defence. You have then completed a DQ and now it has been allocated to the small claims track.

      So- What were the particulars of claim?
      What have you asked for and how- was it a CCA request with a fee? Did you ask for anything else

      What was your defence?

      In the directions was there anything said about exchanging witness statements

      Acknowledge Claim - within 14 days from Service

      Defend Claim - within 28 days from Service (IF you acknowledged in time)

      If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
