    I had a £700 CC debt, that lowells bought from the original company. They took me to the Northampton court and with one thing and another I didnt submit my defence in time.
    Is there anything can do or do I just have to pay up? The problem is I have no job after being sacked due to a mental health issue 12 months ago. I don't really want to ring them which they keep urging me to do, as I am sure they will try and bully me. This is really starting to affect me again mentally. Should I contact them and ask to pay what I can afford, which will be paltry? They can't have what I don't have.

    Was the Default Judgment order forthwith or for installments ?

    As you received the claim it would be very difficult to apply to set it aside, and it sounds like you have known about the judgment for a while.

    It really isn't worth it affecting your health. As you say, they can't have what you don't have. You could contact them and go through income and expenditure to make an installment offer that is affordable - OR you can apply to the court to vary the judgment ( either from forthwith to installment, or lower the installment amount ) This would be done via form N245 which costs £50 but you can apply for fee remission on form EX160.

      Thankyou for your fast reply. It was set up as £100 a month and I am now £100 in arrears according to their time schedule. Theres is no way I can afford that. Thankyou very much for the forms. ;-)
