  • 1st Credit/Lester Aldridge Pre Action Protocol Form

    Its been a while since I've needed some advice but MrJ has received a Pre Action Protocol form from Lester Aldridge regarding an old Lloyds Loan which 1st credit bought in 2013.

    The story so far is this Loan was taken out in September 2004 for £3000 + £830 PPI with 60 months repayment period.
    Due to financial pressures in 2008 payments stopped late in that year.
    The account was defaulted and the outstanding balance was around £860
    No further payments have been made since then.
    MrJ checks his Noodle Credit reference every month and the Lloyds loan was removed around 2 years ago.
    1st Credit was assigned the account in 2013
    MrJ has never contacted 1st Credit about this debt, but we do know they can't be trusted.
    He noticed 1st Credit did a credit reference check in November last year.
    Since then they have sent letters, making offers of discount and then threats of court action.
    This loan account is well into Statute Barred territory, so the questions he has are as follows.

    Does he tick box C or Box D on this form,
    What do you put in the section "I dispute this debt because"
    What documents would you ask for
    Do you have to fill in the Financial Statement.

    If someone could give some advice it would be gratefully received.

        Lesters are good friends of mine (Not) and im surprised they are pursuing what appears to be such as small debt, now then is there any ongoing dispute over the debt? I note you mention PPI was this missold? has it been reclaimed? I ask because it could be used to offset against the sums claimed.

          Hi,

          Many thanks for the reply, their letter was dated 30th January so we assume 30 days from that date.

          We tried to claim the PPI back from Lloyds but didn't have any success, so it is in the Financial Ombudsman's queue ( Just over a year now so about a year to go ).

          This debt we feel is well into statute bared territory.

          We are not to sure what boxes to tick on this new Protocol form, or what we should ask for.

              Sorry been in hospital and havent had a great deal of time to get on line.

              Ok well if you have an ombudsman complaint on going then you should draw this to their attention and ask them to place any planned legal action on hold as the debt could be discharged if the ombudsman rules in your favour, and it wouldnt be appropriate to pursue legal action at this stage.

              They should place matters on hold while the ombudsman investigates
