  • FPN - case re-opened

    My son, 20, received a FPN for dropping litter - stupid boy. He doesnt dispute he did it, but only paid once he received a court date (had been out of work). Paid well in advance, see details below, but due to an error by the council it still went to court. Case is to be re-opened under Section 142 of the Magistrates court act 1980. Really just wondered what to expect and do we need to prepare anything? Have the council receipt to show it was paid on time,


    Date of FPN 25/04/17

    (out of work shortly after – didn’t claim benefits – no money being received -couldn’t pay)

    Reminder from council sent 21/07/17 – Letter stated that if the fine wasn’t paid they would instigate proceedings through the magistrate’s court. The letter said the if payment was made no later than 7 working days before the court hearing then the authority/council will stop the proceedings.

    Letter received from court 02/10/17 – Summons to attend court – case to be heard on 10/11/17

    (new job started – able to pay)

    Payment made to the council 20/10/17 – 14 working days before court hearing - receipt given

    Didn't attend court as fine had been paid

    Letter received after court date to say found guilty in absence – fine £370

    Spoke with authority/council – they admitted it was their fault but we needed to speak with the court as they couldnt do anything

    Letter received from court 18/12/17 – Attachment of earning order

    January 2018- many e-mails and phone calls later letter received from court – Case to be re-opened under Section 142 of the Magistrates court act 1980 – court date 12/02/18


    Any advice welcome and what to say/do in court - as mentioned we have receipt from council and all letters
