  • COURT CLAIM Pay Day Loan

    Hi all,

    I had multiple payday loans back in the day. Some paid off and some outstanding with defaults.



    Within that I had 2 Lending Stream pd loans. 1 for £450 (Court Claim received dated 20/12/17 for £1298.28) and a 2nd pd loan for £150 (Payment demand letter just received for balance of £450).


    I acknowledged the claim and sent off CCA and CPR requests to the Claimant and debt collector, both were Asset Collections and Investigations Ltd but different addresses.


    I have today, 09 JAN 2018, received a response to my requests and have received email attachments of 2 credit agreements, 2 defaults notices and 2 statements of accounts.


    I plan to complain to most, if not all, of the pay day loan companies as I seem to fit the criteria of unaffordability.


    BUT is it TOO LATE to complain on this one if the court claim has already been issued?? - (I will still complain about the smaller pd loan).


    If I still complain about the court claim loan, will that stop the claim until the complaint is resolved?


    Also, the statement of account relating to the court claim does not detail the 3 or 4 £20 payments that i made in early 2017. Does that mean Asset Collections Ltd have failed to comply with my requests??


    Any suggested courses of action??

    Well you can try - sling in a complaint to Lending Stream immediately for all the loans you ever had with them, including these two defaulted ones. Tell Asset Collections that the debts are under dispute and ask them to hold any enforcement activity on the one where a Claim isn't started and ask them to stay the one where there is a claim.

    Also get those complaints in against other payday lenders asap!
