    Good Evening,

    Im going to go straight to the point.
    I was informed that my debt was passed onto Asset Collection and I agreed upon a payment plan to commence on 15/01/2018.

    Today I have recieved the following email:

    Re: County Court Claim

    Customer Reference: ******
    Original Creditor: The Lending Stream
    Outstanding Balance: £887.60 (Includes Court Fees & Interest)

    Dear Mr,

    We have initiated a County Court Claim against yourself to recover the monies owed above.

    You will receive a Claim Pack issued by the courts via the post in due course. You are encouraged to seek competent legal advice with regards to this.

    Failure to complete the relevant documents enclosed in the Claim Pack will result into judgment being entered by default.

    After judgment has been entered by default, you will receive a County Court Judgment. A County Court Judgment will be entered on your credit record at the Register of Judgments, Orders and Fines and will remain there for six years. This record can seriously affect your ability to obtain a mortgage, credit card, bank account and even a mobile phone contract in the future.

    To avoid the judgment in its entirety you must pay the outstanding balance in full prior to the deadline date set out within the Claim Pack. In turn, we will notify the County Court that the account balance has been paid in full and you will not need to complete the Claim Pack.

    There are lots of ways you can make payments, pick the one most convenient for you:

    Contact one of our friendly team on 0330 808 1585 who are available Monday to Thursday 8:00am to 7:00pm and Friday 8:00am to 5.30pm.

    Please clearly write your Asset Collections & Investigation reference number ****** on the reverse of your payment.

    If you are not in a position to pay the account balance in full, we ask that you contact our Litigation Department on 0330 808 1585 to look at setting up a payment arrangement. Note, if you are looking to set up a payment arrangement, judgment would still be entered into.

    Our opening hours are Monday to Thursday 8:00am to 7:00pm and Friday 8:00am to 5.30pm

    What I cant figure is to why they would have iniated this after agreeing on a payment plan but it looks like they have.

    Can anyone please advise me on what I should expect?

    Hi,

    Phone them up and confirm the payment plan is in place then ask why have they sent the email about the court claim.

    Have you looked into complaining to Lending Stream and any other pay day loan to reclaim the interest?

      Stay off the phone to Asset. From now on you need everything in writing.

      You can call NCCBC to check whether a claim has really been issued.

      New debt Pre Action Protocol came into force on 1st October last year which requires a debt owner to send you a ‘Letter Before Claim’ giving you 30 days to respond to it (reply form to complete) before a claim should be issued.

      In my experience Asset dont always follow protocol.

      Sometimes (not always guaranteed) they discontinue a claim when this is pointed out to them.

      You need to establish your legal position.

        I only just realised that you posted... after I had phoned Asset.
        The woman I spoke to assured me that the claim was sent out because of a time lapse in setting up my payment plan. She has told me to disregard the claim and that it will be void. I have requested this to be sent in writing.

        Is it worth emailing them and requesting it again?


        EDIT: No I never recieved any paperwork before hand

          I can confirm that your claim has now been discontinued and you do not need to respond to the claim pack you have received.

          As long as you adhere to your payment arrangement there will be no further legal action taken.

            They need to serve (send) you a Notice of Discontinuance and also file it at court.

            Call NCCBC in a couple of days to see if that's been done just to be safe.

            Since you have not yet filed a Defence they can reissue the claim but that doesn't necessarily mean they will.

            Acknowledge Claim - within 14 days from Service

            Defend Claim - within 28 days from Service (IF you acknowledged in time)

            If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
