    Hi there,

    I've received a letter before action through the post from Lowell Solicitors. This is for a phone contract dating back to 2011.

    I have contacted Lowell to ask for details on the debt such as how much is supposedly owed and when from. I was careful not to acknowledge the debt in any explicit or implicit way.

    Lowell tell me the last payment was made to the account on 11/11, default date was 06/12. Quick math tells me last payment was 6 years 1 month ago and have not since acknowledged or attempted to make any payment towards this supposed debt. Would this be classed as SB?

    If not SB yet, how long after my last payment would the cause of action be? In my eyes, I'm in breach of contract after non payment the following month so i'm therefore SB as of this month give or take. I can no longer get access to my contract from o2 as the account has been closed.

    What should my next steps be? Is there anyway for me to postpone any further action from the company until i can be assured it's SB?

    Any advice is welcome!

    Edit:

    I also have an email from o2 dated 02/02/12 asking for full payment of the complete remainder of the contract. Does this mean by this point my account is in default?

Acknowledge Claim - within 14 days from Service

Defend Claim - within 28 days from Service (IF you acknowledged in time)

If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
