I have a CCJ by default against someone who never defended it, and has known I was going down this route for 14 months. Court bailiffs went to her property but there was nothing of any value.
She has now applied to set aside the judgement stating the house was in fact empty, which it wasn't, but it was for sale.
I had informed her a week ago I was escalating to a high court writ, I then received a letter saying she had applied to have the judgement set aside. What I want to know is, can still apply for the writ, or does her applying to set aside stop me doing this?
