  • CCJ with BW Legal 18/10/2017

    Hi guys received a court letter on the 18/10/17 and need some help what to do next I have done the AOS

    and what i know The account start date is 21/10/2011 and default date on the 01/03/2012 could this possibly be statute barred as I’ve never paid nothing? It is marked as satisfied on the 9/12/2016 on my credit file and has not been assigned to PRAC financial I’ve never received a letter of debt assignment

    Good morning, welcome to LB,

    Please give us some detail of the alleged debt and post a copy of the claim form after removing your name/address/claim number/account numbers. If you need help with this I sure [MENTION=49370]Kati[/MENTION] will be able to help.

      hi this claim is for a payday loan that was took out on 21/10/2011

        Did you receive a formal letter before action prior to receiving the court claim?

        It can't be statute barred as it is within 6 years ( since you took out the loan as well as from when you defaulted )

        Not sure why it would be marked as satisfied on your credit file if they sold it on and you'd never paid anythign towards it. It should be due to fall off the file in March 2018 though.

            You've left the Claim No on the claim form, and both the claim number and the account number on the BW Legal letter.

            You need to remove those.

                It will be shown as satisfied when Payday UK sold the debt to PRAC therefore the debt with PDUK no longer exists
                [MENTION=108562]New6466[/MENTION] Sadly this doesn't mean the debt doesn't exist- debts can be sold but asa Diana M has said there are processes to follow when a claim is issued

                Process is
                1) Acknowledge the claim online with an intention to defend all
                2) Send a CCA request to PRAC http://legalbeagles.info/library/gui...etter-example/
                3) Send a CPR 31.14 request to BW legal asking for the agreement, the notice of assignment, the deed of assignment and the default notice http://legalbeagles.info/library/gui...-of-documents/

                  I have sent the the cca and the cpr 31.14 today with postal order and sent them 1st class recorded.

                    The date on the claim is 18th Oct

                    I assume you have acknowledged in which case the defence is not due until 20th November so plenty of time

                    I would wait and see what they come up with
