  • Rlp seek recovery

I am the mother of an adult daughter who has learning difficulties and suffers from mental health issues. I have supported her for the last 20 years and she has struggled to varying degrees needing more support at different times when she struggles more.

She has had a difficult year and her mental health deteriorated during this period. Within the last 6 months she visited a store and stole some goods. She was apprehended and readily admitted the crime for which she feels terrible and feels that she should be punished. The police were called and she subsequently received a caution. All the goods were recovered by the store.

She subsequently received a letter from RPL claiming cost of recovery of £197. She then received a further two letters threatening court action and entry onto a register which may affect her future employment opportunities. We managed to obtain the service of a local solicitors for free to write a single letter to RPL which basically stated that the matter had been dealt with and my daughter did not have they means to pay any cost.

She has now received a further letter stating costs have been reduced to £138.50 and this must be paid within 14 days or the court proceedings will be taken.

This letter has setback her fragile recovery as she hoped that this matter had finished.

I am looking to try and respond on her behalf on this matter, but do not want to make matters worse and trigger any aggressive responses. I am looking to ask for evidence of cost which clearly outlines a breakdown and ask for a subject access request for all information.

i would warmly welcome any advice or guidance on this matter and suggested approach.

Honestly ... the best thing you can do is IGNORE these letters! RLP have a habit of going for the 'easy prey' in situations like this (IMO)

If you can stay strong for your daughter, the letters should eventually stop (from my research at least )

      Well said Kati.
The letters seem to last anything from 8 to 16 months. If you contact them at all it seems to make them think you are an easy target and they ratchet up the pressure.

Your solicitor was quite correct, in there is no loss to the store and therefore no cause for claim.

RLP were slapped down in court in Oxford a couple of years ago, and as far as is known they have not been back to court.
There is a lot about RLP on this forum and others on the internet, and the advice is always the same "IGNORE"

Ignore them and continue to support your daughter.
