    Hello All, (If this needs to be moved to another forum then feel free)


    Well heres my first post and looking for help! Heres the story…

    We had a guy fit a kitchen and bathroom for us last year (March 2007) and install a shower pump to boast the very low water pressure we have on the hot and for a few weeks it worked well and was happy with it until one day it just stopped working so we called out the manufacturer to take a look at it and when the tech took a look at it he said he could not touch it as it had been fitted incorrectly and one end of the pump had not been connected so it had burned it self out and £200 down the plug hole.

    We sent a letter to the guy that did the work and he has failed to do anything and its been over a year now and want to get him to pay up.

    What will we need to put on the court papers when we need to do this? I am just doing a 14 days notice letter for him again but now ready to take him to small claims.

    Firstly, you might not need to take him to court if you paid him by credit card or VISA debit card. If either of these is the case, go to your credit card/bank and ask them to reimburse you as the goods/services supplied were not satisfactory.

    Failing that (i.e. assuming that you paid by cash or cheque), then small claims court is a good idea.

    You need to get the repair done by an alternative supplier, and then submit to the court your costs incurred and any additional costs you are claiming for inconvenience - loss of earnings whilst waiting in for the plumber etc.

    Documentary evidence of the original supply & fitting arrangement would be helpful if you have them but not required at this stage - all you have to do is set out the basis of your claim which is to get your installation repaired as the original supplier installed it incorrectly.
    That's it, really.
