    2 days ago i won a car on ebay, the description was perfect apart from listing it was a cat c or d, but the description stated light damage to front bumper
    no issues with suspension, airbags or chassis drive away !!!!
    The seller message me with his BUSINESS bank details to send across a £200 deposit via bank trans
    Next day i went to collect the car, its was at a unit with 2 guys working and lots of cars that had clearly been towed or a salvage yard/breakers
    I had a look round the car apart from seeing the damage to front bumper,
    so all the engine lights were on, i asked one of the guys why this was and he said its because the battery had been disconnected and after driving it for a while they would disappear, i called the guy wo sold me the car and he confirmed this the truth and stated that he would get his work colleagues to write on the reciept ALL LIGHTS COVERED meaning he would foot the bill if it wasnt the battery that was causing the issue
    So i transfer the rest of the money £3300 and off i went with the reciept nothing else
    10 mins down the road a tyre blows out, why??? the suspension is wrecked
    call the guy again and i tell him where the car is and me and my friend will be driving back with the key and i want my money back, bear in mind i have 2 young children and i explained that im widowed and using the last of my savings, he assured me it was a great safe car
    Now he tells i cant have my money back and he will get it towed to my house 20 mins away, he once again said any issues i will fix
    so i took the car to a local bmw garage. £4500 to get everything fixed and a strong email to say its the worst theyve seen and that its unsafe for me to drive and to leave it there until i get the guy to come and fix it
    Contacted said salesman ,hes avoiding me and my friend
    after deeper research the said salesman is selling numerous amounts of cars on ebay under 2 private accounts, even though his business name is on my receipt and he has a business account and a business address
    He also told me it was a cat d, after doing a check, it has been in 2 accidents, first a cat d and the most recent a cat c

    I have printed everything off, and i mean everything, i have spoke consumer direct, who have advised me that he is classed as a trader so im covered by certain laws, they tell me they have to inform trading standards, and i have now sent a letter to him recorded delivery giving him 7 days to reply
    I have also printed off an N1 form ready as i know this con man will ignor my letter, i do know about the adr as a course of action but if im honest he will avoid it
    i just my money back so i can by a safer car for me and children (

        Have you taken a screenshot of the description of the advert? If not, that's the first thing you should be doing.

          Screen shot and printed everything including feedback and all other cars he's sold on eBay in the past year

              As quoted in his email message bank transfer into his business account. I have also printed copies of there conversations off
              Surely it's against the law for him to sell to make a profit on eBay as a private seller

                By being a car trader and masquerading as a private dealer he has contravened Consumer Protection from Unfair Trading Regulations 2008.
                This is something to which trading standards should put a stop.

                By selling a car in an unroadworthy condition he is in breach of Road Traffic Act 1988 Sec 75.
                This is a crimnal offence and should be reported to the police.

                However our concern will be to try and recover your money.
                At the moment your obvious course of action is to make a claim in the county court if you get no response to your letter.

                I don't suppose by chance that his business is registered as a limited company?

                  I have been digging all day to find out company information , the name on the receipt isn't showing in Google
                  The business address is only showing a previous tenant which has moved to a new place and also searched the name given on his business account to no avail
                  In the past 2 days he's sold 10 cars adding upto over £50k on eBay
                  We did message him yesterday to say would he be prepared to pay £1500 towards getting the car fixed as we know a garage that's cheaper than bmw but he's just ignoring us now
                  We took it to bmw originally as they do a full diagnostics check and considering all lights were lit on the dash it seemed the best route
                  Probably counting all his money just as we speak

                        What is the name and address of the business? Have you checked in person to see if they are still carrying out business at that address?

                        What letters, if any have you sent and have you sent a letter before action? This type of letter sets out the issues and what needs to be done to resolve it before you initiate court action, which should usually allow up to 14 days for them to respond.

                        You shouldn't be giving contradictory information by offering to pay towards the costs of the repairs and then wanting all your money back that you've paid - it should be one or the other.

                        Contact Trading Standards if you haven't already and explain what's happened. See if they have any information about the trader and whereabouts.

                        Contact Ebay, they can suspend accounts if they are purporting to be a private seller and not a trader.

                        Finally, if you are looking to issue a claim then you need to start gathering information on the business. There's no point bringing a claim if you don't know where they trade from and if they have any money to pay you should the court award judgment in your favour.
