Last Wednesday I got a lumia 925 from Game, a second hand phone (they sell a lot of them). I wanted to use a windows phone as opposed to an android phone so that it would be more compatible with my pc. YHere is my original message to the Game Head office, and their reply.
my original message to Game, where I boguht the phone.
I bought a 925 phone with the assurance I could upgrade it to win 10. It does not. So I took it back and swapped it for a 640, but at £20 increase, spending £100 alltogether. After charging the phone, I installed win 10, and it went in fine. Then noticed a couple of times on Friday, the phone auto rebooted! And again on Saturday.I thought for sec it was doing updates, but no. Then on Saturday evening it did an auto factory reset without my asking!!!! I lost my contacts and two apps I had put in - google maps and messenger. I took phone back to shop (Sutton Coldfield) and told them the problem, I had a phone I no longer want and does not do what I say, but what it says!!! The lad said they would have to test it to see if problem resurfaced, I said test away but I do not want the phone, just a refund. He said, 'that might be awkward' I said - no, this is well within a week of purchase and I am not happy with its performance. I am a pensioner, I do not like the windows phone and want my £100 back. Please advise before I move on to other means.
their reply:
I am sorry to hear of your situation regarding your phone. When trying to return an item to us in store citing a fault we have to investigate in order to see if the item is indeed faulty. Until that is done we cannot process a refund.
If you require any further assistance, please do not hesitate to contact us.

Can they refuse a refund on a phone I only had 4 days?? There is something wrong with it, obviously?? Even if the fault fails to materialise in their shop (they have had it back 2 days now) surely I am entitled to a refund?
