I have been given the runaround by my holiday lettings agency. Over the course of five months they had made false deductions, taken profit from undeclared bookings etc and so I terminated the arrangement. They have now admitted that they had been adding VAT to their invoices despite never being registered for VAT. Obviously all of the above were honest mistakes on their part which they were just about to realise and rectify :angel2:. They withheld the last couple of months of payments. I made a MCOL to which they have counterclaimed for lost earnings.
Obviously there has been a breach of their fiduciary duty to their principle. I'm wondering if it is worth pleading fraud or if there is some lesser and easier option which would still entitle me to rip up the contract without notice.
